Affiliate Terms & Conditions

Your Content, Your Call

We want this to feel like a real partnership, so here's how we treat the content you create — in plain terms. (The full legal language is in Section 7 below; this summary is just to make it easy to understand.)

You own your content. Every photo, video, caption, and review you make stays yours. Nothing here transfers ownership to us, and simply tagging or mentioning us doesn't give us a license to your work.

Organic reshares are the one exception. If you publicly tag or mention Wild Journey, we may reshare that post on our own social channels — but only unedited and only with credit to you. We won't run it as an ad, put it on our website, or use it in email without asking.

Everything else needs your written yes. Paid ads, website, email campaigns, or any editing of your content only happen when you approve that specific content in writing (an email works). We'll tell you exactly what we want to use and where.

You still earn on it. When you approve content for paid or expanded use, you keep earning a commission on the sales that content generates — approving it doesn't waive your pay.

Approvals last 12 months. When you approve something, that permission runs for a year and renews only if we both want to continue. Either of us can give 30 days' notice to end it.

The fine print, briefly. When you share content with us, you're confirming it's yours to share, that anyone in it has agreed to appear, and that it doesn't break any laws or someone else's rights.

Wild Journey Affiliate Program Terms & Conditions

These Affiliate Program Terms & Conditions (“Terms”) govern participation in the Wild Journey Affiliate Program (the “Program”) operated by Wild Journey, a DBA of Varsity Ventures Group LLC (“Wild Journey,” “Company,” “we,” “us,” or “our”).

By submitting an application to, or participating in, the Program, you (“Affiliate,” “you,” or “your”) agree to be bound by these Terms.

1. Program Description

The Program allows approved Affiliates to promote Wild Journey products using unique referral links, discount codes, or other tracking mechanisms provided by Wild Journey (collectively, “Affiliate Tools”) in exchange for potential commission earnings.

Participation in the Program is a privilege, not a right, and is subject to ongoing compliance with these Terms.

2. Eligibility & Enrollment

You must be at least eighteen (18) years of age to apply. All applications are subject to review and approval at Wild Journey’s sole discretion. Wild Journey reserves the right to approve, reject, suspend, or revoke participation at any time, with or without cause.

3. Affiliate Obligations

Affiliate agrees to

a) promote Wild Journey products honestly and in a manner consistent with the brand’s values

b) comply with all applicable federal, state, and local laws, including but not limited to FTC endorsement and disclosure requirements

c) clearly and conspicuously disclose the affiliate relationship in all promotional content

d) ensure all content is original or properly licensed and does not infringe third-party rights.

Affiliate bears sole responsibility for the content they create and distribute.

4. Prohibited Conduct

Affiliate shall not, directly or indirectly:

Make false, misleading, or unsubstantiated claims regarding Wild Journey or its products

Engage in spam, deceptive practices, or fraudulent activity

Bid on Wild Journey trademarks, brand names, or variations thereof in paid advertising without prior written consent

Create social media accounts, websites, or advertisements that impersonate or falsely represent affiliation with Wild Journey

Offer unauthorized discounts, rebates, or incentives

Use Affiliate Tools on coupon, cashback, or deal-aggregation platforms unless expressly approved in writing

Violation of this Section may result in immediate termination, forfeiture of commissions, and potential legal action.

5. Commissions & Payment

Commission rates, eligibility criteria, payment thresholds, and payment schedules are determined by Wild Journey and may be modified at any time.

Commissions are earned only on valid, completed, non-refunded, non-fraudulent transactions.

Wild Journey reserves the right to withhold, reverse, or adjust commissions for returns, chargebacks, suspected fraud, or violations of these Terms.

Affiliate is solely responsible for reporting and paying any applicable taxes.

No commission is guaranteed.

6. Intellectual Property & Brand Usage

Wild Journey grants Affiliate a limited, revocable, non-exclusive, non-transferable license to use approved Wild Journey trademarks, logos, and brand assets solely for participation in the Program and in accordance with any brand guidelines provided.

All intellectual property rights remain the exclusive property of Wild Journey.
This license terminates immediately upon termination of Program participation.

7. User Generated Content License

Affiliate retains all ownership of any content they create, submit, tag, mention, or otherwise provide related to Wild Journey (including but not limited to photographs, videos, audio, written content, testimonials, reviews, captions, and other materials) ("User Generated Content" or "UGC"). Nothing in these Terms transfers ownership of UGC to Wild Journey.

a) Limited Organic Reshare License. When Affiliate tags or mentions Wild Journey in publicly posted content, Affiliate grants Wild Journey a non-exclusive, royalty-free license to reshare that content organically on Wild Journey's own social media channels, provided that Wild Journey (i) does not modify or edit the content, (ii) attributes the content to Affiliate (e.g., by tagging or crediting their handle), and (iii) does not use the content in any paid or higher-value context. This limited license does not extend to paid media, website content, email campaigns, third-party channels, or any edited or derivative use, all of which require written approval under subsection (b).

b) Approved Content License. For any use beyond the limited organic reshare described above — including paid advertising, website content, email campaigns, and any modification, editing, or creation of derivative works — Wild Journey obtains a license only where Affiliate has approved that specific content and those specific uses in writing (email is sufficient). Upon such written approval, and limited to the specific UGC and uses identified in the approval, Affiliate grants Wild Journey a worldwide license to:

    i) Use, reproduce, modify, adapt, edit, publish, translate, distribute, publicly perform, publicly display, and create derivative works from the approved UGC;

    ii) Use the approved UGC for the purposes specified in the written approval, which may include marketing, advertising, promotion, social media, paid media, website content, and email campaigns;

iii) Use the approved UGC with or without attribution, as specified in the written approval.

c) Compensation. In consideration for the license granted under subsection (b), Affiliate is eligible to earn a reduced commission on qualifying sales generated by the approved UGC. Approving content for use under subsection (b) does not waive, reduce, or otherwise affect Affiliate's right to earn commission on sales that content generates. No separate royalty or per-use licensing fee is owed for the approved UGC beyond the commission earned on generated sales.

d) Term of Approved Content License. Each license granted under subsection (b) is effective for a period of twelve (12) months from the date of Affiliate's written approval. The license will automatically renew for successive twelve (12) month periods unless either party provides written notice of non-renewal at least thirty (30) days before the end of the then-current term. Upon expiration of the license without renewal, Wild Journey will cease new uses of the applicable UGC, provided that Wild Journey is not required to recall, remove, or destroy materials already produced, printed, or distributed prior to expiration.

Affiliate represents and warrants that, for any UGC used under this Section:

    a) They own or have obtained all necessary rights, licenses, and permissions for the UGC;

    b) Any individuals appearing in the UGC have provided valid consent;

    c) The UGC does not violate any laws or infringe the rights of any third party.

Wild Journey has no obligation to use any UGC.

8. Term & Termination

Either party may terminate participation in the Program at any time, with or without cause. Upon termination:

a)     Affiliate must immediately cease use of all Affiliate Tools and Wild Journey brand assets

b)     Any unpaid commissions may be forfeited if termination results from a breach of these Terms

c)     Sections intended to survive termination shall remain in effect

9. Independent Contractor Status

Affiliate is an independent contractor and is not an employee, partner, agent, or representative of Wild Journey. Affiliate has no authority to bind Wild Journey.

10. Limitation of Liability

To the maximum extent permitted by law, Wild Journey shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to the Program. Wild Journey’s total liability shall not exceed the total commissions paid to Affiliate in the six (6) months preceding the event giving rise to the claim.

11. Indemnification

Affiliate agrees to indemnify, defend, and hold harmless Wild Journey and its members, managers, officers, employees, and agents from any claims, damages, losses, liabilities, or expenses arising from Affiliate’s participation in the Program or breach of these Terms.

12. Modifications

Wild Journey reserves the right to modify or update these Terms at any time. Continued participation in the Program following any modification constitutes acceptance of the revised Terms.

13. Governing Law & Venue

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict-of-laws principles. Any disputes shall be resolved exclusively in the courts located within that state.

14. Entire Agreement

These Terms constitute the entire agreement between Affiliate and Wild Journey regarding participation in the Program and supersede any prior agreements or understandings.

15. Mandatory Arbitration & Class Action Waiver

Any dispute, claim, or controversy arising out of or relating to these Terms, the Program, or the relationship between Affiliate and Wild Journey (collectively, “Disputes”) shall be resolved exclusively through final and binding arbitration, rather than in court, except that either party may bring an individual action in small claims court if the claim qualifies.

Arbitration shall be conducted on an individual basis in accordance with the rules of the American Arbitration Association (AAA) then in effect. The arbitration shall be held in the State of Texas, County of Travis, unless the parties mutually agree otherwise. The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement.

YOU AND WILD JOURNEY HEREBY WAIVE ANY RIGHT TO A JURY TRIAL for all Disputes to the fullest extent permitted by law.

All Disputes shall be brought solely on an individual basis. Affiliate agrees that they may not bring, join, or participate in any class action, collective action, representative action, or private attorney general action against Wild Journey.

The arbitrator shall not have authority to consolidate claims or award relief on a class, collective, or representative basis.

Each party shall bear its own attorneys’ fees and costs unless otherwise required by law or awarded by the arbitrator. Arbitration filing and administrative fees shall be allocated in accordance with AAA rules.

Notwithstanding the foregoing, Wild Journey may seek injunctive or equitable relief in a court of competent jurisdiction to prevent or remedy misuse of intellectual property, fraud, or unauthorized use of brand assets.

If any portion of this Section is found to be unenforceable, the remaining portions shall remain in full force and effect. If the class action waiver is found unenforceable, the arbitration requirement shall be null and void solely as to that claim.

Affiliate may opt out of this arbitration agreement by providing written notice to Wild Journey within thirty (30) days of accepting these Terms. The notice must include Affiliate’s full name and a clear statement of intent to opt out. Opting out does not affect any other provisions of these Terms.

This Section shall survive termination of participation in the Program.
